Agreement to Terms
These Terms of Service govern your access to and use of Nourish (the "App"), operated by Zach Johnson, doing business as Nourish App LLC ("we," "us," "our"). By downloading, accessing, or using Nourish, you agree to be bound by these Terms. If you do not agree, do not use the App.
Eligibility
You must be at least 13 years old to use Nourish. By using the App, you represent that you meet this age requirement. If you are between the ages of 13 and the age of majority in your jurisdiction, you confirm that you have your parent or guardian's permission to use the App.
Description of the Service
Nourish is a mobile application that helps users plan meals, discover and adapt recipes, build grocery lists, track cooking habits, and optionally log health-related information. Nourish also includes an AI assistant ("Chef Nouri") that can generate meal plans, recipes, and recommendations.
Nourish is under active development. Features may be added, changed, or removed at any time, and the App may from time to time be unavailable for maintenance or updates.
Not Medical or Professional Advice
Nourish is not a medical, nutrition, or healthcare service, and nothing in the App constitutes medical advice. Calorie, macro, weight-goal, sleep, and workout estimates provided by the Health Profile feature are based on general formulas and population averages and are not personalized medical assessments.
You should consult a doctor, registered dietitian, or other qualified professional before making significant changes to your diet, exercise routine, or before relying on Nourish in connection with any medical condition, allergy, or health concern. Do not use Nourish as a substitute for professional medical advice, diagnosis, or treatment.
Recipe Adaptation and Allergens
Nourish includes a feature that automatically suggests ingredient substitutions to adapt recipes for dietary preferences and allergens you specify. While we aim for these suggestions to be accurate, we cannot guarantee that adapted recipes are free from allergens or fully compliant with any specific diet. You are responsible for verifying that any recipe is safe for your individual needs, including checking ingredient labels and consulting a medical professional regarding food allergies or sensitivities.
User Content
If you create, upload, or import recipes, photos, or other content into Nourish ("User Content"), you retain ownership of that content. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display that content as necessary to operate and improve the App.
You are solely responsible for your User Content and confirm that you have the right to share it and that it does not infringe on the rights of others or violate any law.
Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Upload content that is harmful, abusive, infringing, or otherwise objectionable
- Attempt to interfere with, disrupt, or gain unauthorized access to the App or its systems
- Use the App to harass, impersonate, or harm others
- Misuse the AI assistant feature to generate harmful, illegal, or abusive content
We reserve the right to suspend or terminate access to the App for anyone who violates these Terms.
Subscriptions and Purchases
Nourish offers a free tier and an optional paid subscription ("Nourish Pro") with additional features. Subscription pricing, billing, and renewal terms will be presented at the time of purchase through the applicable app store. Subscriptions automatically renew unless cancelled in accordance with the app store's policies. Refunds are handled according to the policies of the app store through which you made your purchase.
Third-Party Services
Nourish uses third-party services, including Anthropic's AI models, to power certain features. Your use of these features is also subject to the relevant third-party provider's terms. We are not responsible for the actions, content, or policies of third-party services.
Intellectual Property
The App, including its design, features, branding, and underlying code (excluding User Content), is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.
Disclaimer of Warranties
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or that any recipe, nutritional estimate, or recommendation will be accurate or suitable for your individual needs.
Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the twelve months preceding the claim.
Changes to the App and These Terms
We may modify, suspend, or discontinue any part of the App at any time. We may also update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
Termination
We may suspend or terminate your access to the App at any time, for any reason, including violation of these Terms. You may stop using the App and delete it from your device at any time.
Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles, unless otherwise required by applicable law in your jurisdiction.
